Terms and Conditions

These Terms and Conditions are effective as of January 1st 2024, and may be amended from time to time and does apply to all of our services.

1. General Terms:

1.1. Icecube Tours website is owned and operated by Icecube ehf. (“Icecube Tours”, “we”,”us”,”our”) registered at Lyngás 1d, 210 Garðabær, Iceland. Icecube ehf. is registered in Iceland, registration nr. 470222-1070, with the VAT number 143827 and licensed by the Iceland Tourism Board, license nr. 2024-013.

1.2. The customer making the booking accepts these conditions on behalf of all members of their travel party and is responsible for payment due from the party in entirety. The customers also accept that the tour and/or activity is taken at their own risk.

1.3. Participants must be physically fit to participate in the activities for which they have enrolled, and must inform the guide, prior to the departure of any medical conditions and/or previous medical conditions that may be triggered or aggravated by such activities.

1.4. Icecube ehf. does not accept liability for any loss, accidents, injuries, or sickness during the time of a tour. We do not assess responsibility for injuries or accidents that are caused by the customers’ actions, or their failure to follow guidelines given by their guide at any time.

1.5. Icecube ehf. reserves the right to change schedules and itineraries should it be necessary due to weather and/or other conditions out of our control (including force majeure). We will always work through these conditions with the customer and come up with an alternative solution if possible. We do not accept liability for expenses and/or other related costs due to factors outside of our control, such as flight delays, changes and/or cancellations, injuries, weather, war, economic effects, natural disasters, pandemics, and other public health concerns, etc. and/or other unforeseeable matters.

1.6. The customer is responsible for providing us with correct contact information and related details so that we can keep them informed in the event of changes made to the service booked. It is also the customer’s responsibility to carefully check all details on the confirmation and related travel documents to ensure they are correct. In the event of a discrepancy, such as booking mistakes where the wrong date and/or the incorrect number of participants was booked, please contact us immediately as it may not be possible to make changes to your reservation when it gets closer to the departure date. Icecube Tours is not responsible for mistakes in the booking process.

1.7. By completing a reservation through our website, the customer acknowledges and agrees to have read, understood, and agreed to the terms and conditions set forth in this document.

2. Prices and Payments:

2.1. Please note that all prices are in Icelandic Krona (ISK) and are including VAT. Prices and departures are guaranteed after full payment has been made.

Icecube ehf. accepts all major credit and debit cards. Purchases made via credit/debit card will go through 3D Secure.

2.2. You can view an estimate of ISK prices in USD, EUR, and other currencies on www.xe.com. This is only to help you understand the approximate price. Your card will always be charged in ISK. We also refund in ISK. Since we do not charge any booking or transaction fees, we cannot be held liable for any losses due to fluctuations in currency exchange rates during transactions, nor any third-party transaction fees that may occur at the time of your payment and/or refund. Keep in mind that your card issuer may charge you a foreign transaction fee. As a local operator, we cannot be responsible for currency fluctuations and/or additional fees outside our control that may be applied, such as bank fees, transfer fees, credit card fees, etc.

2.3. All prices mentioned on our website are current prices and include value-added tax (VAT). We reserve the right to alter or change already published prices on our website without prior notice in case of economic changes, including but not limited to, currency fluctuation, inflations, increased cost of supplies, government taxes, force majeure events, or any such cost increases which are outside our control.

3. Cancellation Policy:

3.1. All cancellations of tours must go through our office by email to info@icecubetours.is The request has to be confirmed by Icecube Tours to be valid. A non-refundable 10% cancellation fee of the total amount will be charged to cover the direct cost of the booking. We will always try to reschedule you for a new tour departure, when possible.

 3.2. A minimum of 72 hours’ notice of cancellation before the scheduled start of your reservation is required for a 90% refund. This also applies to tours cancelled by Icecube Tours due to safety reasons or force majeure events.

3.3. If you cancel between 72 and 48 hours before the scheduled start of your tour, you will receive a 50% refund. This also applies to bookings made between 72 and 48 hours prior to tour departure.

3.4. If cancellation is made less than 48 hours before the scheduled start of your tour, no refunds will be given. This also applies to bookings made less than 48 hours prior to tour departure.

3.5. No refunds will be provided if a client does not show up for their reservation.

3.6. Activities operated by third parties and added to services provided by Icecube Tours are subject to the cancellation policy of the third-party operator.

3.7. Icecube Tours reserves the right to cancel your tour due to safety reasons, due to bad weather or road conditions or other natural conditions with short notice.

4. Northern Lights Tour Disclaimer:

4.1. The Northern Lights Tour are subject to correct weather conditions and sightings cannot be guaranteed with natural phenomenon such as these. We reserve the right to cancel the tour due to unfavorable weather conditions. ( ath vantar upplýsingar um endurgreiðslu )

5. Weather and conditions:

5.1. Icecube Tours reserves the right to alter routes, itineraries, departure times and or cancel your trip without prior notice with your safety in mind, if necessary. We do not give a refund if the client does not show up because of weather conditions in case the tour is on schedule.

5.2. Please keep in mind that the weather can change fast in the northern hemisphere and with it, road and travel conditions can change. This is especially valid for traveling during winter in Iceland. Our guides are experienced in dealing with changing conditions and their number one priority is to make decisions with your safety in mind. Please be aware of this and respect our guides’ authority to do so.

                 

6. Personal Travel Insurance:

6.1. We strongly recommend that clients purchase travel insurance against contingencies, including compensation for medical costs and cancellation fees.

6.2. It is your responsibility to take out comprehensive travel insurance that covers all eventualities including force majeure, flight cancellations, and other disruptions to your travel.

7. Liability

7.1. Icecube Tours cannot be held responsible to any losses, expenses, damages due to delays, changes of flights, closed roads or other services or unforeseeable causes beyond our control because of strikes, accidents, sickness , weather, war, or changes in bus schedules, or other similar causes.

7.2. Icecube Tours does not assume responsibility for accidents or death that can be traced to the participant´s negligence, acts of third parties or exterior circumstances.

7.3. In the event of an emergency medical rescue and/or repatriation from a tour by whatever means, the responsibility of such costs will be borne by the client.

7.4. All luggage and personal equipment are, at all times, at your own risk. We will not be responsible whatsoever for any loss or damage to your luggage and/or personal equipment / clothing.

7.5. In the case of any changes to flights (domestic and international), you are responsible for any additional costs incurred as a result of such changes (i.e., additional hotel nights, meals, transfers, etc.), at the time provided.

7.6. The estimated duration of tours as indicated on our website are standard times and can vary according to the road and/or weather conditions. Punctuality is a key objective of our operations. However, delays may occur for unforeseen reasons. We cannot be made responsible for losses that you may face due to delay, regardless of whether the loss is direct or indirect.

7.7. Icecube Tours will accept liability for its employees’ negligence, causing direct physical injury to passengers only to the extent that it is obliged under Icelandic law. We cannot be held responsible for any mishap to yourself or your property, particularly for the consequences of flight cancellation. Vechile accidents, strikes, sickness, Government or customs, police intervention, or other such happenings amounting to force majeure. By confirming your booking with Icecube Tours, you acknowledge that we have taken all reasonable steps to safeguard its liability in this respect.

8. Governig Law and Jurisdiction:

These terms and conditions are subject to Icelandic laws, rules, and regulations. Any disputes arising out of or in connection with this agreement shall exclusively be submitted to and dealt with by the District Court of Reykjavik.
